Ex solidaritate lux? Vom Aufstieg eines Grundsatzes und seiner Tauglichkeit für die Aussenbeziehungen der EU (Andreas Th. Müller)

In its recent case law, the Court of Justice of the European Union has identified, within the legal framework of the EU treaties, sectoral solidarity principles in the areas of asylum and energy as well as a general solidarity principle. In this way, it has strenghtened the solidarity element within EU primary law. Yet, the normative contours of the solidarity principle, both in its sectoral and general manifestations, remain relatively unclear. In addition, the strengthening of the solidarity principle within the EU begs the question what this implies for third countries and the external relations of the EU.
